Professional Experience

Erin is a member of the Lending/Insolvency and Litigation/Arbitration/Dispute Resolution teams with a background in both banking and financing law as well as commercial litigation. Erin’s unique blend of experiences allows her to provide sound counsel in the ever-evolving world of banking and finance law. Her practice includes acting for chartered banks, private lenders, and borrowers financing transactions at both the local and national level. Erin’s experience includes drafting and negotiating loan and security documentation for various types of financings, including secured and unsecured financings, real estate lending, construction finance, corporate and commercial lending, and acquisition financing.

Erin began her legal career in commercial litigation, practicing at leading commercial litigation and employment law boutiques. Her practice focused on complex commercial litigation matters, including breach of contract claims, securities litigation, shareholder and partnership disputes, breach of fiduciary and breach of confidence claims, and real estate disputes. Erin has represented clients at all levels of court in British Columbia, as well as before administrative tribunals and in private arbitrations.

Erin’s experience in commercial litigation affords her an invaluable perspective of the challenges facing her banking and lending clients. Her understanding of how transactions can go wrong gives her the tools and foresight to help steer clients towards their goals while minimizing the risk of costly and time-consuming litigation.

Prior to commencing practice, Erin returned home to complete a judicial clerkship at the Circuit Court for Baltimore City, where she served as a judicial law clerk to the Honorable Christopher Panos on a felony trial docket.

Representative Work

  • Counsel for the plaintiff in a seven-day trial on the recovery of unpaid capital payments and interest, totaling over $1.6 million.

  • Counsel for the plaintiff, Skycope Technologies Inc., in a twenty-day trial against former employees alleged to have misappropriated the plaintiff’s state of the art anti-drone technology to compete unfairly against them in the Canadian and Chinese markets.

  • Counsel for the plaintiff on a successful application that the defendant had impliedly waived solicitor-client privilege. Counsel for the same plaintiff in the successful defense of the defendant’s application to join additional parties to the litigation. The plaintiff’s success in these matters prevented the adjournment of an imminently approaching trial date.

  • Counsel for the Hudson’s Bay Company in a commercial real estate matter that raised issues regarding the court’s equitable and legal jurisdiction to allocate the economic burden of the COVID-19 pandemic between landlords and tenants.

  • Counsel for a natural resource company in the successful defense of a summary trial application in a confidential commercial arbitration proceeding.

  • Counsel for the Law Society of British Columbia at disciplinary hearings and on applications to stay proceedings on the basis of alleged prosecutorial misconduct and Charter infringements.
