Jasmin practices in the area of commercial litigation and represents and advises primarily business clients in claims and lawsuits involving various contract disputes including contracts for purchase and sale of chattels and real property, exclusive use and non-competition contracts, guarantees and other debt instruments, commercial leases and employment contracts as well as shareholder disputes, allegations of product liability, occupiers’ liability and various corporate matters.
Jasmin has appeared as counsel before both the Supreme Court and Court of Appeal of British Columbia. In addition, she has successfully assisted her clients achieve resolution of their disputes through negotiation and other formal methods of alternative dispute resolution, including mediation.
A representative sampling of some recent cases which Jasmin has litigated in Court or for which she has successfully achieved a settlement for her clients include:
- Represented developer in an action to discharge its obligation to purchase development property due to frustration of the contract: KBK No. 138 Ventures Ltd. v. Canada Safeway Ltd., 26 R.P.R. (3d) 88 (B.C.S.C), affirmed 2000 BCCA 295
- Represented commercial tenant in enforcement of its right to renew a lease agreement: Elk Valley Properties Ltd. v. Video Update Canada Inc. 2000 BCSC 1862
- Defended company and principal in a claim alleging civil fraud, misappropriation of funds and breach of fiduciary duties in relation to use of investment funds, including a claim for a mareva injunction: Xu et al. v. Centre Pacific Management Ltd. et al. 2002 BCSC 1039
- Represented commercial property owner in obtaining favourable interpretation of building scheme to allow contemplated use of property: Kornfeld et al. v. Intrawest Corporation, Exclusive Resorts WH1, LLC et al. 2005 BCSC 1187
- Represented commercial client in defence of claim to enforce guarantee: Canada Life Mortgage Services Ltd. v. Gabriola Garden Homes Society et al., 2006 CarswellBC 2657
- Prosecuted claim on behalf of property owner for trespass and to enforce client’s right to judicial process: Eagle Island Holdings (Two) Inc. v. British Columbia Hydro & Power Authority et al. 2006 BCCA 337
- Commenced action to enforce partnership agreement and shareholder’s rights in an oppression action pursuant to the British Columbia Business Corporations Act
- Represented commercial tenant of shopping centre in enforcing non-competition clause
- Represented parties on the execution of an Anton Pillar Order
- Defended various employers in defence of claims for wrongful termination and other claims arising out of employment agreements
- Brought action on behalf of co-owner of property to force the sale of property and distribution of sales proceeds pursuant to the Partition of Property Act
- Acted as counsel in proceedings for approval of plans of arrangement and amalgamation pursuant to the British Columbia Business Corporations Act (formerly Company Act)
