Professional Experience: David's practice is focused primarily on tax litigation under the Income Tax Act, the Excise Tax Act (GST), the Employment Insurance Act, the Canada Pension Plan and the Social Service Tax Act. His litigation practice includes representing clients in respect of:

  • audits conducted by the Canada Revenue Agency and the B.C. Ministry of Small Business and Revenue;

  • administrative appeals (i.e. objections);

  • appeals to the Tax Court of Canada, Federal Court, Federal Court of Appeal and the Supreme Court of British Columbia;

  • voluntary disclosures of previously unreported tax;

  • criminal investigations, charges and trials for alleged tax evasion; and

  • criminal charges for alleged failure to file tax returns or failure to comply with a requirement letter issued by the CRA

While the vast majority of David's clients' tax issues are settled through negotiation, when necessary, cases proceed to trial and appeal. Significant cases on which David has appeared as counsel include:

  • Manrell v. The Queen (Federal Court of Appeal)

  • Malette v. The Queen (Federal Court of Appeal)

  • A&W Trade Marks Inc. v. The Queen (Tax Court of Canada)

  • British Columbia Transit v. The Queen (Tax Court of Canada)

David's practice also involves assisting clients with their tax and estate planning needs.
